TICKETPRO ONLINE TICKET DISTRIBUTION RULES
1. These Rules (hereinafter referred to as the “Rules”) shall be applied to the distribution of tickets via the online booking-office (hereinafter referred to as the “Online Booking-Office”) of the UAB TICKETPRO BALTICS private limited liability company (legal entity registration number 302631743, registered address: Ramybės g. 4-70, Vilnius, e-mail address: info@ticketpro.lt) (hereinafter referred to as “Ticketpro” or the “Distributor”). The Online Booking-Office shall be administered by Ticketpro.
2. Ticketpro shall not be the organizer of events. Ticketpro shall sell the tickets on commission, on behalf and at the account of the organizer, sponsor, performer or any related person of the event. Ticketpro shall not have the right to fix and/or change the ticket prices and/or the terms and conditions of their sale, therefore, inter alia, Ticketpro shall not decide on the arrangement of the space (seats) during the events, shall not accept returned tickets and shall not replace them, and shall not indemnify the price of destroyed, lost, stolen, damaged, etc. tickets. Ticketpro shall not be liable for any damage related with the event and shall not indemnify the value of any things lost or damaged during the event. The rights and duties applicable to the tickets shall be established and announced by the organizer of a particular event, and Ticketpro shall not be liable for the contents, amendment, performance, etc. of such rights and duties. Any claims regarding the organization, content, quality, advertising, etc. of the event must be presented to the organizer of the event.
3. Ticketpro shall not be a representative of the organizers, performers and participants of any events or a representative of any other persons responsible for the organization, contents, information, advertising or quality of any events. Any liability for this shall be undertaken by the organizer of a particular event whose data shall be announced on the website of Ticketpro (www.ticketpro.lt), and the contact data shall be specified on the ticket(s). Any claims related with the organization of such an event must be presented directly to the organizer of the event.
4. The ticket(s) may not be returned. The ticket(s) may not be replaced. Any special expenses of the buyer (accommodations, travel, etc.) shall not be reimbursed. Forgery of a ticket(s) is a criminal offence. If a ticket(s) is(are) destroyed, lost or stolen, its(their) price shall not be indemnified. The use of any video or audio recording equipment shall be prohibited during the event. The program, date, time and place of the event may be changed. By acquiring the ticket(s) the buyer confirms his permission to use his/her image on all audio and/or video recordings taken at the place of the event without any financial reimbursement.
5. Ticketpro shall have the right to unilaterally limit the quantity of tickets acquired by one person and to terminate a ticket acquisition transaction in the event of its exceeding the established limit. In such a case, the limitation shall define the maximum permitted quantity of tickets, which may be acquired by a buyer through his/her shopping cart at the Online Booking-Office.
6. The ticket(s) shall be issued by Ticketpro at the Online Booking-Office after the buyer has paid for the ticket(s) by any of the following methods of payment: (i) if payment is made via the electronic banking system, after receipt of the order confirmation, (ii) if payment is made by means of a credit payment card, at least 5 business days after the performance of the transaction at the Online Booking-Office.
7. The ticket(s) shall be delivered by post or via courier services only if the ticket(s) is (are) acquired at the Online Booking-office at least 5 business days before the day of the event. Ticketpro shall not be liable for the timely delivery of tickets that are acquired beyond that deadline.
8. The tickets are normally delivered by post/ via courier services on business days from 09:00 a.m. till 6:00 p.m. If the post/courier fails to deliver the ticket(s) to the address agreed upon with the buyer within 5 business days, the postal/courier services shall be considered performed (the delivery fee shall not be refunded), and the buyer shall take the ticket(s) from the point(s) of sale of Ticketpro according to the buyer’s residence or registered address. The buyer agrees and undertakes to arrange with the provider of postal/courier services the place and time of delivery of the ticket(s) within 5 business days from the day of acquisition of the ticket(s).
9. The specified delivery times of the ticket(s) are approximate, and Ticketpro shall not be liable for the delayed delivery of the ticket(s), when the reason for such a delay is inaccurate or incorrect information or instructions provided by the buyer, the acts of third persons and/or any other circumstances beyond the control of Ticketpro. Ticketpro shall have the right to suspend the delivery of tickets, if the address specified by the buyer is inaccurate or incorrect or if the buyer could not be found. If the buyer does not receive the ticket(s) before the established deadline, the buyer must address Ticketpro in writing within 10 days by sending a notification to the following address: M.Valančiaus g. 1A, Vilnius or by e-mail: info@ticketpro.lt.
10. The ticket(s) must be kept in a safe place. Direct sunlight and heat may damage the ticket(s).
11. Ticketpro shall not be obliged to accept the returned ticket(s) or to refund the price of the ticket(s) if the respective event is cancelled, adjourned or transferred to another place. The ticket(s) must be accepted and the price of the ticket(s) refunded by the organizer of the respective event, unless otherwise specified in the ticket(s).
12. Ticketpro shall not be liable for the data, comments or any other information published by members of the forum at the website of Ticketpro.
13. The website of Ticketpro may contain links to any web pages and/or websites. Since Ticketpro does not control such web pages and/or websites or the information published therein, Ticketpro shall not be liable for the accuracy, relevancy and content of such information.
14. It shall be prohibited to use the website of Ticketpro, its contents or information for any unlawful activities, inter alia for the purposes of ticket sale or resale, advertising or any other business purposes, or for any other benefit, including purposes of intermediation during the acquisition of the tickets, without the advance written consent of Ticketpro. By agreement between the parties, the amount of the minimum loss suffered by the Distributor as a result of violation of the said obligation shall be a fine in the amount of 10,000 (ten thousand) Litas, which shall be paid by the buyer to the Distributor.
15. The Buyer is prohibited from interfering with the activities of the Online Booking-Office and from using any functional means and/or technical solutions of the Online Booking-Office of Ticketpro. It shall be prohibited to perform, for any purposes, the monitoring of the use of the Online Booking-Office, to perform any calculations and/or copying, reproduction, modification, use and publication of any data obtained (including the content of the web page). For this reason, it shall be prohibited to perform any activity which may impede the work or functioning of the Online Booking-Office and the web page of Ticketpro. Ticketpro shall reserve the right to impose a fine in the amount of up to 10,000 (ten thousand) Litas upon any buyer for a breach of the terms and conditions of the agreement, who shall violate the said provision. By agreement between the parties, the amount of the minimum loss suffered by the Distributor as a result of a violation of the said obligation shall be a fine in the amount of 10,000 (ten thousand) Litas, which shall be paid by the buyer to the Distributor.
16. In the event of a violation of the terms and conditions of the use of the Online Booking-Office, Ticketpro shall have the right to unilaterally prohibit access to the Online Booking-Office and/or suspend any ticket acquisition transaction performed by such a person.
17. By performing any act at the Online Booking-Office, the Buyer confirms to the Distributor that: (i) he/she is at least 14 years of age (if the buyer is a natural person); (ii) the buyer is a legal entity and its representative has all authorization to lawfully act and assume obligations on its behalf (if the buyer is a legal entity); (iii) the buyer has familiarized himself/herself with the present Rules and agrees to comply with their terms and conditions.
18. The Buyer confirms that he/she has voluntarily provided all personal data to the Distributor. The Buyer agrees to the processing of his/her personal data (name, surname, residence address, e-mail address and username) for the purposes of direct marketing, buyer servicing and registration during the acquisition of tickets to the events and for the purposes of granting discounts. The Buyer confirms that Ticketpro has notified him/her, as the subject of the data, about his/her right to refuse the processing of his/her personal data. The buyer agrees to the processing of his/her data by Ticketpro in the procedure specified by legal acts of the Republic of Lithuania. The buyer agrees to receive the newsletters sent by Ticketpro to the specified e-mail address.
19. Acquisition of tickets under a special price shall not guarantee access to the event. A person, who has a ticket acquired under a special price, shall have the right to access the event if he/she complies with the conditions specified by the organizer, which shall be verified by the persons appointed by the organizer at the place of the event.
20. Neither Ticketpro, nor the organizer shall be obliged to check whether the person, who has presented the ticket, is the same person who has acquired it, and they shall not be liable for any damage suffered in relation to this. When the buyer gains access to the event on the basis of the printed ticket, it shall be considered that the buyer has gained access to the place of the event, when he/she presents the printed ticket to the organizer for the first time.
21. Ticketpro does not have the right to see payment card information, which is related to the payment transactions performed by the buyers. To perform their payments, the buyers shall be directed to a secure environment provided by the bank payment card centre. During the payment transaction, the card owner shall enter the data in the payment card centre server database and any data related with the payment transaction shall be recorded in the payment card centre server memory. Ticketpro shall not be liable for the inaccurate and incorrect data of payment cards. For the purposes of preventing fraud, Ticketpro may monitor the buyers’ IP addresses in order to track any orders submitted from the same IP address by using different payment cards or by specifying different recipients. In the event of any suspicious activity, Ticketpro shall immediately notify the respective bank.
22. In the event of any suspicious activity, the bank shall have the right to suspend the payment transaction until the completion of an investigation or to cancel such a transaction. In such a case, the bank shall notify Ticketpro about the investigation and Ticketpro shall not sell any ticket(s) to the buyer until the completion of the investigation.
23. If the data of a card is required, its protection shall ensured by the SSL systems, “MasterCard Secure Code” and “Verified by Visa”.
24. The Buyer must keep the username and the password given for the purposes of using the Online Booking-Office so as to prevent any third persons from discovering them, unless the persons have been duly authorized by the buyer to use the Online Booking-office on his/her behalf.
25. The Buyer shall immediately notify Ticketpro by e-mail about any data or circumstances that have changed following his/her first registration as a user of the Online Booking-Office.
26. The Rules shall become effective following their confirmation by the buyer and shall remain in effect as long as the buyer and Ticketpro are bound by any legal relations specified in these Rules. The Buyer shall have the right to refuse to comply with these Rules within 14 days following their confirmation on the condition that the buyer has performed all the obligations undertaken by these Rules.
27. Ticketpro shall have the right to amend the Rules unilaterally by publishing the amendments on the web page of Ticketpro. The amended Rules shall become effective on the day of their publication on the web page of Ticketpro.
28. Any disputes related with the present Rules shall be settled in a court of the Republic of Lithuania in accordance with the law of the Republic of Lithuania.
